AdvaView End User License Agreement (EULA) and Terms of Use
Effective Date: July 30, 2026
This End User License Agreement ("Agreement") governs the use of the AdvaView® Zero Footprint Viewer ("AdvaView", "Software", or "Viewer") provided by AdvaHealth Solutions ("AdvaHealth Solutions", "we", "our", or "us"). This Agreement applies solely to AdvaView and supplements, but does not replace, the terms and conditions governing your use of AdvaPACS. Your access to and use of the broader AdvaPACS software-as-a-service application remains subject to AdvaHealth Solutions' Terms of Service, available at https://advapacs.com/advapacs-terms-of-service/ and Acceptable Use Policy, available at https://advapacs.com/advapacs-acceptable-use-policy/ (collectively the "AdvaPACS Terms of Service"). By accessing or using AdvaView, you acknowledge that you have read, understood, and agree to be bound by this Agreement and the AdvaPACS Terms of Service. If you do not agree to these terms, do not access or use the Software. In the event of a conflict between this Agreement and the AdvaPACS Terms of Service with respect to AdvaView, the terms of this Agreement will control solely with respect to AdvaView, unless expressly stated otherwise.
1. Purpose of the Software
AdvaView is a web-based zero footprint medical imaging viewer intended to enable authorized users to access, review, and interact with medical imaging studies and related information.
The Software may be configured for:
- Diagnostic use where appropriately cleared and licensed; or
- Non-diagnostic, administrative, educational, research, or reference use.
Certain features, functions, or workflows may not be available in all jurisdictions or configurations.
2. Authorized Use
You have a revocable, non-exclusive, non-transferable, limited license to use the Software only:
- For lawful purposes strictly in accordance with the terms of this Agreement;
- In accordance with applicable healthcare, privacy, and data protection laws;
- In compliance with your organization's policies and procedures; and
- Within the scope of your authorized credentials and permissions.
You agree not to:
- Reverse engineer, decompile, disassemble, attempt to derive source code, or create derivative works from the Software or its contents;
- Circumvent security, authentication, or access controls;
- Use the Software in a manner that could damage, disable, or impair system performance or availability;
- Introduce malicious code, malware, or unauthorized integrations;
- Access data or studies for which you do not have authorization;
- Use the Software for unlawful surveillance, data mining, or unauthorized disclosure of patient information.
3. Medical and Clinical Use Disclaimer
AdvaView is intended to support qualified healthcare professionals and trained users. The Software is not a substitute for clinical judgment, professional interpretation, or independent medical decision-making.
Users are solely responsible for:
- Reviewing images and associated information;
- Confirming the accuracy and completeness of data;
- Applying appropriate clinical workflows and procedures; and
- Verifying patient identity and study context before diagnosis or treatment decisions.
AdvaHealth Solutions does not practice medicine and does not provide medical advice. AdvaHealth is not liable for medical malpractice or negligence resulting from the misinterpretation of Software data.
4. Regulatory and Diagnostic Limitations
Certain versions or deployments of AdvaView may not be cleared or licensed for diagnostic interpretation in all jurisdictions.
Unless specifically indicated by applicable labeling, regulatory clearance, or organizational configuration:
- The Software is not intended for primary diagnosis on mobile devices;
- The Software is not intended for mammography or digital breast tomosynthesis interpretation; and
- Certain advanced visualization or image processing tools may be intended for review or reference purposes only.
Users are responsible for ensuring that all use of the Software complies with applicable local regulatory requirements and organizational policies.
5. User Accounts and Security
Users are responsible for maintaining the confidentiality of their login credentials and access methods.
You agree to:
- Use only your assigned credentials;
- Immediately report suspected unauthorized access or security incidents;
- Log out or secure access when not actively using the Software; and
- Follow all organizational cybersecurity and password policies.
AdvaHealth Solutions is not responsible for losses resulting from unauthorized use of user credentials caused by user violation of user responsibilities under this Agreement, user negligence, or user organizational security failures.
6. Data Privacy and Protected Health Information
AdvaView may display or process protected health information ("PHI") or personal information depending on system configuration and deployment. You agree that all information you provide to AdvaView or otherwise, including, but not limited to, through the use of any interactive features on the Application, complies with our AdvaPACS Data Protection Notice, available at https://advapacs.com/advapacs-data-protection-notice/.
Users must comply with all applicable privacy and data protection laws, including but not limited to:
- HIPAA;
- HITECH;
- PIPEDA;
- GDPR; and/or
- Other applicable regional privacy regulations.
Users may not export, copy, transmit, or disclose patient information except as authorized by law and organizational policy.
AdvaHealth will process data in accordance with the Business Associate Agreement executed by User or otherwise in compliance with the Data Protection Notice.
7. Availability and Service Performance
AdvaHealth Solutions does not guarantee uninterrupted or error-free operation of the Software. System availability may be affected by:
- Internet connectivity;
- Third-party systems or integrations;
- Browser compatibility;
- Maintenance activities and software updates;
- Cloud infrastructure availability; or
- External cybersecurity events.
Users acknowledge that temporary outages, delays, or interruptions may occur.
8. Third-Party Systems and Integrations
AdvaView may interface with third-party systems including, but not limited to:
- PACS;
- VNA systems;
- RIS;
- EMR/EHR systems;
- DICOMweb services; and
- Identity or authentication providers.
Your use of these third-party systems and integrations may be subject to additional terms, conditions and requirements made available by us or the applicable third party, and you agree to comply with them. We encourage you to read the terms of service, privacy policies of these third-party systems and integrations. We have no control over the third party systems and integrations, their websites, terms of services, or privacy practices.
You acknowledge, understand, and agree that AdvaHealth Solutions is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of, or reliance on:
- Data accuracy originating from third-party systems;
- Third-party system availability;
- Network routing or infrastructure failures; or
- Compatibility issues introduced by external vendors or unsupported configurations.
9. Intellectual Property
The Software, including all related:
- Interfaces;
- Workflows;
- Documentation;
- Graphics;
- Logos;
- Designs;
- Source code; and
- Functional components
are owned by or licensed to AdvaHealth Solutions and are protected by applicable intellectual property laws. All rights not expressly granted under this Agreement are reserved by Company.
No ownership rights are transferred to users under this Agreement.
10. Feedback
Any suggestions, enhancement requests, recommendations, or feedback provided by users regarding the Software are owned by Company and may be used by AdvaHealth Solutions without restriction or compensation unless otherwise agreed in writing.
11. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVAHEALTH SOLUTIONS DISCLAIMS ALL WARRANTIES, INCLUDING:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT;
- ACCURACY;
- RELIABILITY; AND
- UNINTERRUPTED OPERATION.
ADVAHEALTH SOLUTIONS DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR THAT ALL DEFECTS WILL BE CORRECTED.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVAHEALTH SOLUTIONS SHALL NOT BE LIABLE FOR ANY:
- INDIRECT;
- INCIDENTAL;
- SPECIAL;
- CONSEQUENTIAL;
- EXEMPLARY; OR
- PUNITIVE DAMAGES,
INCLUDING LOSS OF DATA, LOSS OF BUSINESS, LOSS OF PROFITS, OR INTERRUPTION OF OPERATIONS ARISING FROM USE OF THE SOFTWARE.
IN NO EVENT SHALL ADVAHEALTH SOLUTIONS' TOTAL LIABILITY EXCEED THE FEES PAID FOR USE OF THE SOFTWARE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, IF ANY.
13. Indemnification
You agree to indemnify and hold harmless AdvaHealth Solutions, its officers, employees, contractors, affiliates, and partners from claims, damages, liabilities, and expenses arising from:
- Misuse of the Software;
- Violation of this Agreement;
- Unauthorized disclosure of patient information; or
- Violation of applicable laws or regulations.
14. Termination
This Agreement remains effective until terminated.
AdvaHealth Solutions or the deploying organization may suspend or terminate access to the Software at any time for:
- Security reasons;
- Policy violations;
- Unauthorized use;
- Regulatory compliance concerns; or
- Operational requirements.
Upon termination, users must cease use of the Software immediately.
15. Changes to the Agreement
AdvaHealth Solutions reserves the right to modify this Agreement at any time. Updated versions may be published within the Software, associated documentation, or organizational portals. Where a change is material, we will provide reasonable notice to you by email, through the Software, or by any other reasonable means.
Continued use of the Software following updates constitutes acceptance of the revised terms.
16. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction in which the Software is licensed or deployed, without regard to conflict of law principles.
17. Waiver
No failure to exercise, and no delay in exercising, on the part of AdvaHealth Solutions, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder.

By using AdvaView, you acknowledge that:
- You are an authorized user;
- You understand the intended use and limitations of the Software; and
- You agree to comply with this Agreement and all applicable laws and organizational policies.
